BRIEF NOTE ON THE POLICY OF ACP SCHEME, 

COURTS' ORDERS ON ADMISSIBILITY OF ACP SCHEME FOR EA, SEA & AE OF AIR &DD 

 

             The 5th Central Pay Commission had recommended for introduction of Assured Career Progression scheme (in short ACP scheme hereinafter) for the central Government civilian employees as a safety net to deal with the problems of genuine stagnation and hardship faced by the employees due to lack of adequate promotional avenues.

             The Union Government had accepted to introduce the ACP scheme recommended by the Pay Commission and notified it vide Government of India, Department of Personnel &Training’s OM No. 35034/1/97-Estt.(D), dated 09.08.1999 (click to read PDF file of the order). As per the broad guide-lines of the scheme, the employees of Group B, C and D have been allowed maximum 2 financial up-gradations to the next higher grades in the existing or analogous hierarchy of posts after 12 and 24 years of regular service in the grade (to be counted from the date of direct entry in Govt. service) if no regular promotions during the prescribed periods have been availed by them. The Government had also issued a set of 32 clarifications vide DOP&T’s O.M. No. 35034/1/97- Estt. (D) (Vol. IV), dated 10.02.2000 (click to read PDF file of the order) on points raised by various Ministries/Departments pertaining to implementation of the ACP scheme wherein, at Sr.No.1, it has clarified that an employee who got promoted from lower pay scale to higher pay scale as a result of promotion prior to 01.01.1996 and the pay scales of his feeder and promoted posts have been merged by the 5th Pay Commission during the rationalization of structure of  new pay scales effective from 01.01.1996, he shall be entitled for upgradation to the next higher scale in the hierarchy under the ACP scheme ignoring the said promotion.

             The subordinate engineering employees of AIR & DD were denied the benefits of the ACP Scheme by Ministry of I&B and DOP&T on the grounds that they have already availed  upgradation of their pay scales by Ministry of I&B's order dated 25.02.1999 (click to read PDF file of the order). 

             The direct recruit diploma holder EA, SEA, & AE of AIR &DD formed a forum named 'Akashvani & Doordarshan Diploma Engineers Association' and filed an OA No. 514 of 2002 before Patna Bench of CAT, lead by its President Sh. B.K.Roy, SEA and 11 other members of the Association working at AIR/DDK Patna, for grant of benefits of the ACP Scheme under Clarification No. 19 & 32 of the clarifications dated 10.02.2000 of DOP&T in the analogous hierarchy of CCW of AIR & DD. The OA was allowed vide order dated 07.09.2009 with direction to the Govt. to grant 1st Financial Upgradation in the pay scale of Rs 8000-275-13500 corresponding to pay scale of Assistant Executive Engineer of CCW of AIR &DD by ignoring all previous promotions from EA to SEA and thereafter from SEA to AE since all the pre-revised lower and higher pay scales of Rs 2000-3200, Rs 2000-3275 and Rs 2000-3500 held by the posts of EA, SEA and AE respectively had been merged to a single revised pay scale of Rs 6500-10500 by the 5th CPC wef 01.01.1996 (click to read PDF file of the order)

             The Govt. challenged the order dated 07.09.2009 passed in OA No. 514 of 2002 by CAT, Patna Bench by filing a C.W.J.C. No. 6451 of 2010 before Hon’ble Patna High Court. Hon’ble High Court had upheld the order of the Tribunal by order dated 25.08.2010 with the modification to the extent that the cases of the applicants be considered individually in accordance with the scheme of the ACP and the clarification contained in DOP&T’s order dated 10.02.2000 while granting them the pay scale of Rs 8000-275-13500 under the scheme of ACP.

             Thereafter, the Union of India went to Supreme Court of India filing SLP No. CC 20212 of 2010 against the judgment dated 25.08.2010 passed by Hon,ble Patna High Court in C.W.J.C. No. 6451 of 2010 ( arising of order dated 07.09.2009 of CAT, Patna Bench in OA No. 514 of 2002). The SLP was dismissed on facts on 10.01.2011. Thus the case reached to the finality.

             The Ministry of I&B took advice of DOP&T, Ministry of Finance and Ministry of Law on next course of action, which had advised to implement the order dated 07.09.2009 of CAT since no other option was left after the Govt's SLP was dismissed by Supreme Court and the case had attained finality. Ministry of I&B then decided and issued order dated 29.06.2011 (click to read PDF file of the order) for implemention of order dated 07.09.2009 in case of petitioners only. The Screening Committee of Ministry of I&B in which two members were Chief Engineers of AIR &DD have however decided and passed orders on 04.11 2011 to the petitioners saying that the ACP Scheme was not admissible to them and that no one was found eligible for grant of the benefit (click to read PDF file of the order). When informed to the CAT of this decision of the Screening Committee during the Contempt proceedings, Hon’ble Tribunal held that the order dated 04.11.2011 of the respondents was not in consonance with the order of this Tribunal dated 07.09.2009 in OA No. 514/2002 as well as the order of High Court dated 25.08.2010 in C.W.J.C. No. 6451/2010 and the instructions of the DOP&T in the order dated 10.02.2000. Hon’ble CAT directed for the personal appearance of the CEO, Prasar Bharati to explain why charges for contempt should not be framed against him.

             The Screening Committee then hurriedly viewed its decision of 04.11.2011 and recommended to implement the order dated 07.09.2009 of CAT but in case of only 8 applicants by misinterpreting the judgment that it was passed in case of only 12 applicants of the OA and not for all the members of the association (click to read PDF file of the recommendations of the Screening Committee) . The DG:AIR issued order No. 8/3/2011-S-IV(B)pt.II, dated 17.01.2012 granting pay scale of Rs 8000-13500 to 8 applicants wef 01.01.2008 instead of actual dates had 12 years of service been counted from the dates of initial appointment in service (click to read PDF file of the order) .Four applicants including Sh. B. K. Roy were denied the benefits of the ACP Scheme on false and fictitious grounds that they did not ever draw in the pay scale of Rs 6500-10500. This was again a mischievous attempt to implement the ACP Scheme but in quite impaired manner which was brought to the notice of the Court by the the applicants in the contempt application.

             The contempt petition CCPA 22 of 2011  filed before CAT, Patna Bench against non-implementation of order of the CAT in ACP case was disposed of by Hon'ble CAT by the order dated 23.05.2012 with the following observations and directions,

  • (a) That the Govt. has granted the benefit of ACP scheme to the petitioners quite erroneously by misinterpretation of judgment and going by the literal meaning of the words in para-9 of the order dated 07.09.2009 of the CAT.

  • (b) That any dispute on the methods of implementation of court's order is not under the purview in a contempt proceedings and that, if any, can be decided through a fresh OA if filed by the petitioners. 

  • (c) That the petitioners may represent to the Govt. afresh for grant of the benefits of the ACP as per the provisions of the scheme and various clarifications issued by DOP&T in the matter and the direction set out in the order dated 07.09.2009 of CAT and the order dated 25.08.2010 of High Court.

  • (d) That if any representation is filed by the petitioners, the Govt. should go by the letter and spirit of the entire order of CAT as well as the order of Patna High Court, instead of being circumscribed limited by para-9 of the order of CAT.

  • (e) That the petitioners may prefer filing of a fresh OA before the Tribunal for correct implementation of ACP scheme.

             Though the Govt. has implemented the order dated 07.09.2009 of CAT in correct way and in accordance with the rules of ACP Scheme in case of one of the applicants Sh. B. K. Roy, SEA of AIR, CBS, Patna now (click to read PDF file of the fixation order), it implemented the ACP Scheme erroneously in case of 8 other applicants in OA No. 512/2002 and it has not implemented at all in case of rest 3 applicants of  OA No. 512/2002 till now. Three petitioners ( Sh. H. K. Mishra, Shri Sudhanshu Kumar & Sh. Manoramjan Kumar) of the main OA No. 514/2002 who were granted pay scale of Rs 8000.275-13500 wrongly wef 01.01.2008 as 1st upgradation under ACPS (click to read PDF file of the fixation order), had filed OA No. 350/2013 before CAT, Patna for implementation of ACP Scheme to them in correct way in accordance with the rules and as per the direction dated 23.05.2013 of CAT, Patna Bench passed in contempt application No. 22/2012.  The OA has been decided on 31.01.2014 in favour the petitioners.  

           Although, the decision dated 07.09.2009 passed by CAT, Patna Bench had attained finality after Govt. was defeated in Patna High Court and Supreme Court and also, the nodal ministries of Union of India ( DOP&T, Ministry of Expenditure and Ministry of Legal Affairs) had vetted the case and advised to the Ministry of I&B to implement the Court's order being no other option than to implement the judgment, nevertheless the Ministry of I&B had filed a Review Petition (Civil) No. 141/ 2012 before Patna High Court to quash original order dated 07.09.2009 of the Patna CAT and to review its own earlier decision dated 25.08.2010 in CWJC 6451/2010 in the ACP case.  Govt's this action was only to  trifle with the issue and delay the implementation of ACP scheme to others, because the case had already attained finality from the Supreme Court of India. The Review Petition came for hearing on 23.10.2013. Hon'ble High Court opined that the Review Petition, having no merit, needed to be dismissed. On this, the Government's counsel prayed that he may be permitted to withdraw the Review Petition which was allowed by the court (click to read PDF file of the High Court order). Now, there is no case pending  in any of courts challenging the order dated 07.09.2009 of CAT, Patna Bench. The Govt. has to grant now the benefit of ACP Scheme to all the eligible employees in the cadres of EA, SEA, AE and ADE of AIR &DD.

 

              Though a court's verdict has to be implemented suo motu in case of all similarly situated employees without forcing every one of them to approach courts of law for the same relief, the Ministry of I&B has always been trifling with the judgments if it belonged to subordinate engineering employees. On the contrary, the Ministry has been implementing the CAT judgments in individual cases to all of the officers and to all the cadres if it belonged to Class A officers, without filing any review application or challenging in higher courts. For extension of the benefits of the order dated 07.09.2009 of CAT, Patna Bench in ACP case, plethora of court cases had to be filed by the eligible employees and the Ministry of I&B has not implemented the orders of the Tribunal even after the time limit given by the Tribunal for implementation was over.

 

              Ministry of I&B filed one more Writ Petition CWJC No. 1869/2015 before Patna High Court for rescinding of CAT, Patna's judgment dated 07.09.2009 in OA No. 514/2002 and withdrawal of its earlier order dated 25.08.2010 in CWJC No 6451/2010, but the High Court dismissed the Writ Petition having no merit. Hon'ble Patna High Court has held the judgment dated 07.09.2009 in OA No. 514/2002 fully valid in one another Writ Petition CWJC No. 2797/2014 filed by Sh. N. K. srivastava & 5 others vide judgment dated 29.06.2015. The Ministry of I&B has so far implemented in case of following 26 engineering employees :

 

              (a).  09 applicants (out of 12 applicants) in OA No. 514/2002 titled Akashvani & Doordarshan Diploma Engineers Association v/s UOI & Ors. decided by 

                      CAT, Patna Bench.

              (b).  01 applicant in OA No. 477/2011 titled Praveen Kumar v/s UOI & Ors. decided by CAT, New Delhi.

              (c).  16 applicants (out of 23 applicants) in Doordarshan Engineering Employees Welfare Association & Ors v/s UOI & Ors. decided by CAT, New Delhi.

        

            It may also be noted that ACP benefits has been allowed to Shri B. K. Roy, SEA, AIR, CBS, Patna  in correct way counting 12 years of service from the date of his initial appointment in service. The Patna Bench of CAT has further directed the Govt. vide order dated 31.01.2014 in OA No. 350/2013 to grant the benefits of the ACP Scheme to 3 petitioners also ( Sh. H.K.Mishra, Sh. Sudhanshu Kumar and Sh. Manoranjan Kumar) by counting 12 years of service from the date of their initial appointment in service as has been allowed in case of Sh. B. K. Roy.
